The short version

These terms cover the website and general inquiries. A signed engagement governs the work itself, and if the two differ, the signed engagement wins. Baqshi does not hold client money: we charge our own service fees and connect people. Transaction and escrow money is held and released by independent lawyers and banks, not by us. We coordinate property transfers and builds; we do not give legal, tax, or financial advice, and we do not guarantee an approval, a price, or an outcome.

1. About these terms

These terms apply when you visit baqshi.com, use its contact tools, or send us an inquiry. They also apply to general information we give you before an engagement.

They do not replace a signed engagement letter, services agreement, escrow agreement, or build contract. If there is a conflict, the signed agreement prevails for that work.

By using the site, you confirm that you can enter into a binding contract and that you agree to these terms. If you do not agree, do not use the site. If you use the site for a company or another person, you confirm that you are authorised to do so.

2. Who we are

Baqshi is a global property consultancy based in New Zealand, working in 90+ countries. We help clients find property, understand what a cross-border purchase or build requires, settle a transfer, and build with our partners.

Baqshi is the trading name used on this website. The Baqshi entity that contracts with you, its registration details, and its registered office are named in your engagement letter or services agreement. If you need those details before engaging us, ask.

You can contact us at hello@baqshi.com or on +64 27 338 8500. Our support page lists every way to reach us.

3. Using this website

You may use the site for lawful, personal, or internal business purposes. You must not:

  • use it in a way that breaks any law, regulation, or sanctions regime;
  • interfere with the site, its security, or another person’s use of it;
  • scrape, crawl, harvest, or extract content or personal information except as allowed by law;
  • impersonate another person or misrepresent your authority;
  • upload malware, attempt to gain unauthorised access, or probe the site’s security; or
  • copy, resell, or commercially exploit the site or its content without our written permission.

We may suspend or refuse access to protect the site, our clients, or other people. We may also decline an inquiry that is outside our scope, presents a conflict, or would require us to act unlawfully.

4. What Baqshi does, and does not do

Our services include finding property, qualifying a cross-border purchase, coordinating a transfer on escrow, coordinating an open-book build with QSME, and connecting clients with local lawyers, notaries, banks, registries, and government bodies.

We do not hold your money. Our invoices cover Baqshi’s own service fees. We do not receive, hold, pool, or transmit purchase money, deposits, or escrow funds on anyone’s behalf, and we do not control their release. Escrow runs through the independent lawyers and banks in the transaction. We connect the parties and coordinate the steps; we are not the escrow agent, trustee, or payment provider.

We coordinate; we do not replace the professionals and institutions a transaction needs. Unless a signed agreement says otherwise, we do not act as your lawyer, notary, bank, real estate agent, construction contractor, tax adviser, financial adviser, or immigration adviser.

We do not provide legal, tax, financial, investment, accounting, or immigration advice. You should take independent advice before making a decision. Local lawyers, notaries, banks, registries, government bodies, and other third parties act under their own rules, and we do not control them.

We do not guarantee that a property is available, that you are eligible to own it, that a transfer or build will be approved or completed, that finance will be offered, that a title is clear, or that a property will achieve a particular price, cost, yield, or margin. Figures and examples on this site are illustrative unless we state otherwise in writing.

5. Inquiries and consultations

An inquiry, call, message, form, or call-back request does not create a client relationship or a contract for services. It is a request to talk.

A client relationship begins only when you and the relevant Baqshi entity have signed or otherwise accepted a written engagement, and any required initial payment has been received. We may ask for identity, authority, and source-of-funds information before we accept an engagement.

Consultations may be free or paid. If a consultation is paid, we will confirm the fee and scope before it starts. Do not send confidential documents, original title documents, or funds until we have confirmed how they should be handled.

6. Engagements, fees, and payment

Each engagement is separate. The engagement sets out the scope, fees, payment schedule, expenses, taxes, deliverables, deadlines, assumptions, and termination rights.

Unless the engagement says otherwise, fees are exclusive of taxes and third-party costs. Third-party costs such as legal, notary, registry, bank, translation, travel, inspection, valuation, and construction costs are yours.

Invoices are payable as stated in the engagement. Where the law allows, we may pause work on overdue invoices and charge interest on late amounts. No success fee, commission, or referral fee is payable unless it is agreed in writing.

Partner services, including QSME and consistent.CEO, are provided under their own terms and fees unless the engagement says otherwise. Any transaction money, deposit, or escrow amount is never paid to Baqshi and is never held in a Baqshi account. It moves between the parties and the independent lawyers, banks, or escrow agent under the relevant escrow, trust, or settlement arrangement, not under these website terms. Baqshi’s invoices cover only its own service fees.

7. Your responsibilities

You agree to:

  • give us accurate, complete, and current information, and tell us promptly if it changes;
  • confirm that you have authority to act for any company, trust, owner, or co-owner you represent;
  • comply with the law, tax, foreign-ownership, currency, and sanctions rules that apply to you;
  • provide documents and decisions when we reasonably need them;
  • verify payment instructions directly with the lawyer or bank, and never send purchase money or escrow funds to a Baqshi account;
  • take independent legal, tax, financial, and valuation advice where it matters; and
  • not ask us to do anything unlawful, misleading, or unethical.

You are responsible for the property, transfer, and build decisions you make.

8. Property, legal, tax, and financial decisions

Property law, foreign-ownership rules, taxes, fees, and currency controls differ by country and change. General information on this site may not fit your situation, and it is not a substitute for local advice.

We may rely on local lawyers, notaries, public registers, and official sources. We do not warrant that those sources are accurate, complete, or current. You should satisfy yourself about the property, title, encumbrances, zoning, permits, taxes, and valuation before you commit.

Exchange rates, taxes, fees, and timelines can change. Past or illustrative performance is not a forecast, and no investment return is promised.

9. Third parties and partner services

We may introduce you to lawyers, notaries, banks, surveyors, valuers, insurers, construction partners, and other third parties. They are independent. Their own terms, fees, and privacy policies apply, and we are not responsible for their acts or omissions except as the law requires.

Links on this site are for convenience. A link is not an endorsement, and we may have a commercial relationship with a partner. Where relevant, we disclose the relationship and any fee in your engagement.

When we coordinate a third party, we do so as your consultant, not as that party’s agent. You remain responsible for the instructions you give them.

10. Escrow, payments, and builds

Baqshi does not hold or control escrow money. In current transactions, escrow is arranged through independent lawyers and banks. They hold and release the money under the escrow or settlement agreement and the rules that apply to them. We are not the escrow agent, trustee, or payment provider, we do not have access to the funds, and we cannot release, freeze, redirect, or unwind them.

We work with each country’s regulations. A cross-border purchase can carry different requirements on the buyer’s side and the seller’s side, including foreign-ownership and investment rules, currency controls, source-of-funds and anti-money-laundering checks, taxes, notarisation, and registry formalities. We map those requirements and match them between buyer and seller so the transaction can be structured to satisfy both sides. Local lawyers, notaries, and banks confirm and apply the rules under their own regulatory obligations.

Matching requirements is coordination, not a legal opinion or a guarantee. A regulator, bank, registry, or court may still refuse, delay, or impose conditions on a transaction, and the rules can change while a transaction is running.

Escrow, payment, and build services are governed by separate agreements. Those agreements set out the technology, network (if any), accounts, release authorities, conditions, deadlines, fees, and dispute process.

Nothing on this site is an offer to hold funds, a promise that a particular technology is available in your country, or a representation that a protocol is live, audited, or on a main network. The white paper describes the current status. Test-network tokens have no value.

Release and unwind happen as the agreement defines. Delays can occur because of banks, registries, lawyers, government bodies, or technical issues. Build cost estimates and schedules are not guarantees; changes and variations follow the build agreement.

Open-book means the records and visibility defined in the relevant agreement. It is not a promise of a particular price, margin, or result.

11. Website content and intellectual property

The site, its text, graphics, design, code, and marks are owned by or licensed to Baqshi. You may view and print pages for your own non-commercial use. You may not reproduce, adapt, distribute, scrape, or use the content to build a competing service without our written permission.

The Baqshi name, logo, and marks are ours. Nothing on this site grants you a licence to use them.

If you send us content, you grant us a non-exclusive licence to use it to respond to you, provide the services, and meet legal obligations. You confirm that you have the rights needed to send it. We may use de-identified, aggregated information to improve our services.

12. Availability and changes

We may change, suspend, or withdraw the site or any part of it without notice. We do not guarantee that the site will be uninterrupted, secure, or free of errors.

Some features may be labelled as in development, pilot, or beta. They may change or stop, and they are used at your own risk.

We may update these terms from time to time. The version and effective date at the top of this page show the current version. The updated terms apply from that date. A signed engagement is not changed by a website update.

13. Disclaimers

To the maximum extent permitted by law, the site and general information are provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, non-infringement, availability, or security.

We do not warrant that the site is free of viruses, harmful code, or errors, or that any information is complete or current. Nothing on the site is a recommendation to buy, sell, or invest in any property or jurisdiction.

You are responsible for your own due diligence and for the advice you choose to rely on.

14. Limitation of liability

To the maximum extent permitted by law, Baqshi and its directors, officers, employees, contractors, and partners are not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profit, revenue, opportunity, goodwill, data, or anticipated savings, arising from your use of the site or reliance on general content.

To the extent liability cannot be excluded, our aggregate liability arising out of or relating to these terms or the website is limited to the fees you paid to Baqshi for the service giving rise to the claim in the 12 months before the event.

Nothing in these terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be limited or excluded by law.

Nothing in these terms excludes or limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot be excluded. If you acquire services for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply to the extent permitted by law.

15. Indemnity

To the extent permitted by law, you indemnify Baqshi against third-party claims, losses, and reasonable costs arising from your breach of these terms, your unlawful use of the site, the information or instructions you give us, or your infringement of another person’s rights.

This does not apply to the extent the claim is caused by our negligence or breach of these terms.

16. Privacy

Our Privacy and data protection policy explains what personal information we collect, why we collect it, who we share it with, and the rights you have. It forms part of how we handle your information.

17. Ending or suspending use

We may suspend or end your access to the site or an inquiry if you breach these terms, misuse the site, create a risk for us or another person, or if the law requires it. You may stop using the site at any time.

Ending access does not affect rights or obligations that have already arisen, a signed engagement, or provisions that are intended to survive.

18. Governing law and disputes

These terms are governed by New Zealand law.

Before starting court proceedings, both sides will try in good faith to resolve the dispute for at least 20 working days after written notice. Nothing prevents either side from seeking urgent relief or complaining to a regulator.

The courts of New Zealand have non-exclusive jurisdiction. If mandatory consumer law in your country gives you a different forum or additional rights, those are not affected. A signed engagement may have its own dispute clause, which prevails for that engagement.
